Conscious Uncoupling?
16 Apr 2014
The term, ‘Conscious Uncoupling’ has recently been used by a celebrity couple to describe their decision to separate following a numbers of years of marriage.
The decision to separate must be a difficult decision for any couple.
Before a couple are able to ‘Consciously Uncouple’ they must have proper advice to be able to make informed decisions about their separation.
At Grainger Appleyard Solicitors we aim to provide our client’s with professional advice which is delivered in a clear and sensitive manor.
One issue that we are frequently asked to advise on is what will happen to the matrimonial assets following a divorce. Common questions include, what will happen to the house? Who will pay the mortgage? Can I claim a share of the pension?
Each case is different and it is important to consider all cases on their own facts. The Matrimonial Causes Act 1973 states that it shall be the duty of the court to have regard to all of the circumstances of the case, first consideration being given to the welfare while a minor of any child of the family who has not attained the age of eighteen.
At Grainger Appleyard we always discuss with our clients the importance of both parties making full and frank financial disclosure to each other before an agreement is reached.
Clients can be surprised to learn that even after a divorce has been granted the financial claims that either party may have as a result of the marriage have not been extinguished. In order to for the financial claims to be finalised it is necessary for the court to make a financial order and what is known as a ‘Clean Break Order’.
We believe that it is important for every person considering a ‘conscious uncoupling’ to take professional advice which is delivered in a clear and sensitive manner. At Grainger Appleyard Solicitors we strive to provide our clients with all of the relevant advice at what we know is a very difficult time.
